HOAM is a marketplace platform only. We connect hospitality professionals with employers, recruiters, and training organisations. We are not an employer, staffing agency, or employment intermediary. We do not transfer money, guarantee shifts, guarantee staff attendance, or accept liability for disputes between users.
1. About HOAM
HOAM Hospitality Ltd ("HOAM", "we", "the platform") provides an online marketplace that enables hospitality professionals ("Talent"), businesses ("Employers"), recruitment agencies ("Recruiters"), and training bodies ("Organisations") to connect, communicate, and transact. HOAM is a technology intermediary only. We facilitate connections - we are not a party to any employment contract, staffing arrangement, training agreement, or financial transaction between users.
2. HOAM is a Marketplace - Not an Employer or Agency
Key principle: HOAM does not employ anyone and does not act as a staffing agency.
- No employment relationship: HOAM is not your employer. Using the platform does not create an employment, worker, or contractor relationship between you and HOAM.
- No money transfer: HOAM does not process, hold, transfer, or guarantee any payments between Employers and Talent. Any payment arrangements are strictly between the Employer and the Talent or Recruiter. HOAM accepts no liability whatsoever for non-payment, late payment, disputes about pay, or any financial arrangements between users.
- No shift guarantee: HOAM does not guarantee that any shift will be filled, that any Talent will attend a shift, or that any Employer will honour a shift booking. The platform facilitates introductions only.
- No replacement guarantee: HOAM does not guarantee that a replacement worker will be found if a Talent cancels or does not attend. Any staff swap, cover, or substitution arrangement is entirely between the parties involved.
- Staff swaps are user arrangements: Any arrangement where an Employer shares, lends, or swaps staff with another Employer is a direct agreement between those Employers. HOAM facilitates the introduction only and accepts no liability for any outcomes, disputes, or losses arising from such arrangements.
3. No Liability for Disputes
HOAM expressly excludes liability for:
- Any dispute between Talent and Employers regarding pay, hours, working conditions, or termination
- Any dispute arising from a staff swap, staff sharing, or cover arrangement between Employers
- Non-payment or underpayment by any Employer
- Failure of any Talent to attend a shift or fulfil a commitment
- Loss of earnings, business loss, or reputational damage arising from use of the platform
- Inaccuracy of user-provided profile data, skills, or certifications
- Outcomes of any training, assessment, or certification arranged through the platform
Reporting: Users may report other users or companies for misconduct through the platform. HOAM reserves the right, at its sole discretion, to investigate reports and suspend or permanently ban accounts that violate these Terms. HOAM makes no guarantee of any particular outcome from a report and does not act as an adjudicator or arbitrator in user disputes.
4. User Responsibilities
By using HOAM, you agree that you are responsible for:
- The accuracy and legality of all information you provide
- Ensuring you have the right to work in the UK before accepting shifts
- Complying with all applicable employment law, tax obligations, and regulations
- All contractual, financial, and legal arrangements you enter into with other users
- Keeping your login credentials secure
- Treating other users with respect and professionalism
5. Employer Responsibilities
- Employers are solely responsible for verifying a worker's right to work before engagement
- Employers are solely responsible for complying with all employment, payroll, health & safety, and equality legislation
- Employers posting shifts confirm they have the authority and legal standing to hire for those positions
- Employers must honour all pay arrangements agreed directly with Talent
6. Account Deletion
You may delete your account at any time from within the app. Account deletion is permanent and will result in the removal of your profile, shift history, and all associated data within 30 days, subject to any legal retention obligations. To delete your account: go to Profile → Settings → Delete Account.
7. Intellectual Property
All platform content, design, trademarks, and technology are owned by HOAM Hospitality Ltd. You retain ownership of content you upload (e.g. your CV, portfolio) but grant HOAM a non-exclusive licence to display and process it to provide the service.
8. Platform Availability
HOAM provides the platform "as is" and makes no warranty of uninterrupted availability, error-free operation, or fitness for a particular purpose. We may suspend, modify, or discontinue features at any time without liability.
9. Limitation of Liability
To the fullest extent permitted by law, HOAM's total aggregate liability to any user for any claim arising out of or related to use of the platform shall not exceed the greater of £100 or the fees paid to HOAM in the preceding 12 months. HOAM shall not be liable for any indirect, consequential, incidental, or special damages.
10. Governing Law
These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
11. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes via the platform or by email. Continued use after changes constitutes acceptance.
